Faytech North America touch displays are produced following the most modern production methods and testing processes. Carefully chosen components and quality production ensures the reliable operation and long life of the Faytech NA products. The Faytech NA warranty covers the original buyer and guarantees that the faytech product will be delivered free of any material defects or manufacturing flaws when shipped. Additionally, each Faytech NA product delivered meets the published product specifications for a twelve (12) month period beginning at the original shipment date. Faytech North America obligation under Warranty contained herein will be limited to the repair or the replacement of any Faytech NA device that does not conform the specifications, provided that said product is returned to faytech North America offices, transportation charges pre-paid, and provided that upon Faytech NA’s review, the product, when examined and tested within specified ratings and in line with solid engineering practices, does not fulfill the defined specifications.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
All claims under warranty must be made immediately after the occurrence of the circumstances giving rise thereto and has to be received during the applied warranty period by Faytech NA or an authorized representative. Such claims have to include: the “product type” in addition to the “serial number” along with a full description of the circumstances resulting in the claim. Before any Faytech NA products are returned for adjustment and/or repair, a Faytech NA written authorization or the authorized representative for the return is required along with detailed instructions as to where and how the Faytech NA product(s) should be shipped must be acquired. Any product returned to Faytech NA for examination or review will be sent prepaid via the transportation means defined as satisfactory by Faytech NA. Additionally, Faytech NA has the right to reject a warranty claim that is not promptly reported and/or any warranty claim on a Faytech NA product that has been altered or has been shipped by unacceptable forms of transportation. When any Product is returned for examination and inspection, or for any other reason, the Customer is responsible for any and all damage that results from improper handling or packing and for any losses in transit, not including any defect or nonconformity in the Product. In every warranty case Faytech NA assumes sole responsibility for determining the causes and the origins of any failure, and Faytech NA’s determination is considered final. If it is determined that Faytech NA‘s Product has been returned without just cause and is still serviceable and functioning as intended, the Customer will be notified and the Faytech NA Product will be returned at the Customer’s expense. In addition, a charge for testing and examination may, in Faytech NA‘s sole discretion, be made on Products so returned.
SELLER’S LIABILITY FOR DAMAGES SHALL NOT EXCEED THE PAYMENT, IF ANY, RECEIVED BY SELLER FOR THE UNIT OF PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED AS THE CASE MAY BE WHICH IS THE SUBJECT OF CLAIM OR DISPUTE. IN NO EVENT SHALL SELLER BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES. LIABILITY TO THIRD PARTIES, FOR BODILY INJURIES (INCLUDING DEATH), RESULTING FROM THE SELLER’S ACTIONS SHALL BE DETERMINED IN ACCORD WITH APPLICABLE LAW AND THE TOTAL LIABILITY LIMIT AS STATED ABOVE SHALL NOT BE CONSTRUED AS A LIMITATION ON THE SELLER FOR DAMAGES FOR ANY RELATING BODILY INJURY (INCLUDING DEATH).
THE WARRANTY FOR ANY ITEM REPLACED UNDER WARRANTY
Whenever a failed component, part or module is replaced under Warranty, the greater of the balance of the original Warranty Period or 90 days will make up the remaining warranty period. A replaced Faytech NA unit does not carry a new Warranty.
LIFE SUPPORT POLICY “WARNING: DO NOT USE IN LIFE SUPPORT”
SELLER’S PRODUCTS ARE NOT AUTHORIZED FOR USE AS CRITICAL PARTS OR COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS WITHOUT THE EXPRESS PRIOR WRITTEN APPROVAL OF THE FAYTECH NA PRESIDENT OR AN OFFICER OF FAYTECH NA. As used herein, a “Life Support Device or System” are any devices that sustain or support life and whose failure to perform when properly used in accordance with instructions for use supplied in the product labeling is reasonably expected to result in a significant injury to a user. As described, a “Critical Component” in this context is any part, component or piece in a device intended for life support purposes or life support system whose breakdown or failure to function as intended or perform as well as is reasonably expected as the cause of the life support device or system failure or anything affecting its safety, performance or effectiveness.
If your device does have a defect during the warranty period, contact Faytech NA directly. The warranty period is twelve (12) months from the date of purchase under the following conditions:
- All warranties are void if the unit has been opened or disassembled without Faytech NA prior approval.
- Damage caused by improper handling or operation, by incorrect installation or storage, through improper connections, as well as due to force majeure or other external influences are not covered by the warranty.
- For warranty claim, we reserve the right to replace the defective components or to exchange the device.
- Exchanged components or devices become the property of Faytech NA.
- Claims for damages are excluded in so far as they are not based on intent or gross negligence of the manufacturer.
- After expiration of a warranty period, a warranty claim can no longer be pursued.
- Any warranty claim must be accompanied by proof of purchase (receipt or invoice).
